Who can raise an appeal?
Anyone can raise an appeal if you are not in agreement with the outcome of the decision made by the Planning Authority. This can come from the applicant if a decision to refuse their proposal was received, or opposition to an approved decision if other parties wish to challenge the outcome of the decision granted.
How does the appeal process work?
To appeal a decision, you must complete a form which you can obtain from The Planning Inspectorate, Temple Quay House, 2 The Square, Temple Quay, Bristol BS1 6PN or the Appeals area at www.planningportal.gov.uk
The Secretary of State need not consider an appeal if it seems to him that the Council have no option under planning legislation but to refuse permission or impose a particular condition, having regard to the statutory requirements to the provisions of any development order and to any directions given under a development order.
How long does an appeal process take?
This depends on the nature of the appeal but figures from the planning inspectorate reveal it can take between five to ten months for an appeal decision to be made.
